Foreign natural persons may enter and reside in the Republic of Serbia under the terms of the Law on Foreigners, with a valid passport containing a visa or residence permit, unless the Law or international agreement prescribes otherwise.
In exceptional cases, as provided by the Law on Foreigners, a foreigner may apply for a visa at a border crossing. Such an application is to be submitted to a police officer at the border crossing.
If the requirements specified by the Law are met, a foreigner may, in exceptional cases, submit a visa extension application. Such an application is submitted to the relevant Ministry of Interior authority, in accordance with the foreigner’s place of residence. The visa validity period may be extended for 90 days at most.
A foreigner may be granted temporary residency in Serbia for the period of up to one year, and such temporary residency may be extended for the same period. Temporary residence permit is entered into the foreigner’s travel document, where such travel document’s period of validity must not expire for at least three months after the validity period of the permit.


A foreigner married to a citizen of the Republic of Serbia may have his/her temporary residency extended for up to three years or until such time the requirements for permanent residence have been met. A foreigner who is a spouse of the citizen of the Republic of Serbia may be granted an extension of his/her temporary residence permit in case the citizen of the Republic of Serbia is deceased, as well as in case the marriage was divorced, provided that marriage had lasted in the Republic of Serbia for the period of at least three years.

 

The application for granting temporary residency should, depending on the grounds for residency, be accompanied by additional documents (for instance, in case of establishment of a company, representative office or bank, decision on registration of the company and a current account turnover statement issued by the business bank).

A foreigner holding a temporary residence permit who continually resided in Serbia for the period longer than five years may be granted permanent residence in Serbia.
