Laws and regulations
Temporary importation is regulated by the Articles 133-140 of the Law on Customs Policy of BiH (the Law, in local language) („Official Gazette BiH“, No. 57/04, 51/06, 93/08 i 54/10) and Articles 350-381 of the Decision on Implementing regulations of the Law on Customs Policy (the Decision in local language) („Official Gazette BiH“, No. 63a/04, 60/06, 57/08) with requirement of development of additional implementation measures.
Subject
Temporary importation shall be permitted for goods that are not BiH goods, with full or partial exemption from payment of import duties and without its subjecting to the measures of trade policy, and which is intended for re-export and did not suffer any change except ordinary reduction of value due to its usage.
BiH signed ATA Convention that is ratified and published in the Official Gazette BiH, International Agreements, No. 1/10. In BiH, temporary importation is implemented based on Guidelines on implementation of Customs Procedure related to ATA Carnet (Official Gazette BiH, No. 34/11)
Types of goods which are accepted for temporary import with full exemption from payment of import duties with ATA Carnet are defined by the Convention and include goods intended for exhibitions at fairs and presentations, special equipment (music, computers, sports etc), goods for science, culture etc. ATA Carnet does not allow import of consumable and perishable goods, goods intended for processing, cultivation or repair, as well as promotional materials which are to be given to visitors during fairs or exhibitions on the territory of temporary import.
ATA Carnet can also be used during transport of goods through several countries before their return to the country of origin, with condition that such goods are not changed. ATA Carnet validity period is one year from the date of issue, but the institution which issues the Carnet determines the specific expiration date in each individual case. For goods entering into BiH territory ATA carnets issued in other countries are accepted if they are issued based on the ATA Convention in a county which is a signatory of the Convention and if they were issued by the authorized issuing association.
Documents, certificates, used during temporary importation
In BiH, Foreign Trade Chamber BiH issues the ATA Carnets. The Carnet can only be issued to domestic legal entity or physical person, but they also can have an agent, i.e. a person who is travelling with the goods and the Carnet. All information on issuing, prices and necessary procedures and documents are available on the official website of the Chamber .
Systems/methods used for import duties
All issues regarding the methods of calculation of import duties can be found in the Guidelines on implementation of Customs Procedure related to ATA Carnet (Official Gazette BiH, No. 34/11) mentioned above issued by the ITA.
Authorization
In BiH, Foreign Trade Chamber BiH issues authorizations for the ATA Carnets. All information on necessary procedures and documents is available on the official website of the Chamber.
Period for re-export of imported goods
The Deadline for re-export of the goods temporarily imported into BiH territory under ATA Carnet is determined by the relevant customs office in BiH at the time of import and is determined individually based on the type of goods, the purpose of temporary import and intended period of stay in BiH of the said goods.
